This Data Use and Consent Statement describes the data that we gather from you through this website and other communications with you based on the contact information you give us. It tells you what data we gather, how we use it, and how we protect it.

“We” means three companies: Preston Spire (“Preston Spire”), 83bar, LLC (“83bar”), and Medtronic plc. (“Medtronic”). We work together in different ways to support Medtronic products and give you information about those Medtronic products.

This Data Use and Consent Statement applies to every person using this website in the United States.

You agree to the terms of this Data Use and Consent Statement by voluntarily answering survey questions on this website.  Answering questions is your choice. By doing so, you give us permission to add your information to our databases, share it between us, analyze it as needed, and contact you with more communications. We will keep all information you give us confidential.

We gather data through your answers to survey questions on this website. We also gather data from phone calls, emails, and other communications with you that may result from you choosing to give us your contact information.

83bar and Preston Spire each host websites and administer surveys. Both 83bar and Preston Spire also receive the data from completed surveys. Preston Spire uses the data to create materials and communications for you about Medtronic products.

The type of data we gather depends on your answers to the survey questions on this website and information you give us through other phone calls, emails, and electronic communications with you. Types of data gathered may include:  

• Personal data – information used to personally identify you, including your name, email address, and telephone number 
• Demographic data – information used to help categorize you, including your gender, location, and employment status 
• Health data – information about your specific medical condition as it relates to the survey topic
• Technical data – information about the way you use and interact with the website, surveys, and communications from us

We use data to help support Medtronic products and give you relevant information about Medtronic products. Specifically, 83bar contacts you through emails, text messages, and phone calls to help connect you with a doctor to decide if a Medtronic product is the right health choice for you. Preston Spire uses the data to create health-related digital information, educational materials, advertisements, tools, and flyers with information customized to your health. Any health information you give us will only be used for the specific reasons you agree to or to comply with laws.

Third parties other than Preston Spire, 83bar, and Medtronic might use the data if we hire them to help us with our business (for example, our vendors or suppliers). If so, we’ll contractually require those third parties to protect data in the same way that we protect data. Otherwise, we will not share data with other third parties without your permission.

We won’t use data for marketing purposes that are unrelated to the information you give us through website surveys and other communications with you.

We store, maintain, and protect data based on what data privacy and security standards are required in our industry, including those from the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This includes removing any information from the data  that could directly identify you when appropriate (known as “de-identifying” the data).

Yes. We comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to the extent HIPAA applies to our  business activities.‍

• Right to know – the right to receive notice about what personal information we’ve collected about you within the last 12 months, where that information was collected from, the third parties we shared that information with, and whether we sold that personal information to others

• Right to delete – the right to request the deletion of your personal information (subject to certain exceptions)
• Right to opt-out – the right to opt out of the sale of your information to third parties
• Right to non-discrimination – the right to not be discriminated against for exercising any CCPA rights

No. Per the Children’s Online Privacy Protection Rule (COPPA), we do not provide services for or knowingly collect information from children under the age of 13. If we learn we have received personal information from a child under age 13, we will delete that information. We may update this Data Use and Consent Statement as needed and without prior notice. Any changes will be posted on this page with a version number and date.
